Trump just took his attack on the Judicial Branch to a whole new level by threatening to dismantle the very court which just yesterday overturned his toxic orders to withhold funding from so-called “sanctuary cities.” The court also previously ruled against Trump’s muslim ban.
The Washington Examiner reports that Trump says he has “absolutely” considered proposals to split up the 9th Circuit. .
The feckless president has had his illegal executive orders repeatedly overturned by federal courts. Given his fetishization of dictatorial practices, it makes sense that he would consider unconstitutional retaliation.
The entire foundation of the American system is the separation of powers. Circuit courts fall squarely within the domain of the Judicial Branch, which is supposed to be insulated from the whims of the Executive Branch.
Appointments to the circuit are selected by the president, and confirmed by the senate. That said, the courts are expected and entitled to exercise jurisprudence despite how the president may feel about a ruling.
Trump’s threat to break up the 9th Circuit sends a clear message: he will abuse executive powers to intimidate and corrupt the judicial branch.
The 9th Circuit reviews appeals from district courts in Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington.
“There are many people that want to break up the 9th Circuit. It’s outrageous,” Trump said, in his usual nonsensical appeal to nonexistent authorities.
The Republican Party has tried in the past to break up the 9th Circuit to lessen its influence, but so far no such legislation has succeeded. The wellbeing of all Americans rests on their continued failure.
