INESCAPABLE: Former Trump attorney says likelihood of Trump indictment is "very high"

Former Trump White House attorney Ty Cobb is the latest legal advisor to former President Trump to admit things aren’t looking good for ex-commander in chief. Cobb agrees with former Trump Attorney General Bill Barr’s statement that the DOJ has all the evidence it needs to continue its criminal investigation and possible indictment despite recent setbacks in Judge Aileen Cannon’s court.

In fact, Cobb says the possibility of a Trump indictment is “very high.”

On an episode of The Takeout with CBS News’s Major Garrett, Cobb shared his opinions on the Big Lie, the Department of Justice’s criminal investigation, the January 6th insurrection, and the simplest way to nip Trump fever in the bud.

As the liaison between Trump and investigators during the Mueller probe, Cobb was a key part of the former President’s inner circle, giving the attorney a front-row view into the inner workings of Trump’s world and, scarily, his mind.

Blaming Trump’s refusal to accept the results of the 2020 election results on his former boss’ “abject narcissism,” Cobb told Garrett:

“I believe former President Trump to be a deeply wounded narcissist and he is often incapable of acting other than in his perceived self-interest or for revenge.”

Though he criticized the broad scope of the Department of Justice’s warrant to search Trump’s Mar-a-Lago estate, the long-time conservative legal expert asserted the agency was within its legal right and scope to perform the search.

“There were grounds for the search,” Cobb acknowledged, “based on the classified documents that they had previously received. Notwithstanding the fact that in June they had discussions about how to acquire more, they certainly had the right—the legal right—to do a search. It’s not unusual for a President to comingle some documents but typically you work closely with the Archives and with the intelligence agencies to get the back to them as quickly as possible.

Cobb joined the White House shortly after Robert Mueller was appointed as special counsel, and, while believing there wasn’t enough evidence to implicate Trump in any wrongdoing, the conservative lawyer praised the former FBI Director as “an American hero.”

Cobb refuted Trump’s claims that the investigation into Russian interference in the 2016 election was unfair to the former president, telling ABC News, “I don’t feel the investigation is a witch hunt.” He added that he wished the investigation “had happened on a quicker time frame,” while acknowledging the pace was not Mueller’s fault, Politico reported.

Garrett asked Cobb about his thoughts on the seriousness of Trump’s legal situation, leading him to admit he believed his former boss to be in jeopardy—but not for the reasons we may think.

Separating the alleged mishandling of classified government documents from what he considers to be more serious crimes of insurrection and obstruction after fairly losing the election, Cobb said:

“I think the [ex] president is in serious legal water, not so much because of the search, but because of the obstructive activity he took in connection with the Jan. 6 proceeding and the attempts to interfere in the election count in Georgia, Arizona, Pennsylvania, and perhaps, Michigan.”

But according to Cobb, the way to get rid of Trump and prevent him from getting anywhere near the Oval Office again is through his actions on January 6th.

It’s “the first time in American history that a president unconstitutionally attempted to remain in power illegally,” he said. “In my own view, and there are constitutional practitioners and scholars who agree or disagree, I believe that would merit prosecution.”

Cobb elaborated, saying:

“I don’t think the Big Lie, interfering with Pence, saying ‘Mike deserves this,’ when people are shouting ‘Kill Pence,’ I think that’s outrageous. I think interfering with what the Vice President was obligated to do —trying to persuade him in very aggressive efforts not to certify the election and send certain electors back—I think that was criminal.”

For those wondering if Trump will ever be held accountable and what can be done to prevent him from coming anywhere near the White House again, Cobb offers an obtainable solution:

“There is a simple way to disqualify President Trump. He clearly violated the 14th amendment of the constitution, Article III, when he gave aid and comfort, in three hours of inaction with regard to what was happening on the Capitol and sent out the equivocal email . . . tweet, I’m sorry, about Pence, suggesting that Pence had failed. That clearly gave aid and comfort to the insurrectionists.”
