IMPEACHMENT INQUIRY: Veteran federal prosecutor calls for investigation into Supreme Court justice
Legal analyst Glenn Kirschner isn’t buying the denial from Supreme Court Justice Samuel Alito that he didn’t leak the 2014 Hobby Lobby decision.
Kirschner told MSNBC‘s Katie Phang that “There should absolutely be an impeachment inquiry and investigation.”
“The time has come for an investigation,” Kirschner said.
Former anti-abortion activist Rev. Rob Schenck dropped a bombshell recently, sending a letter to Chief Justice John Roberts that detailed a conversation Schenck had with an evangelical donor, who told the pastor that Justice Alito confided the upcoming decision during a dinner with the Justice and his wife.

Schenk wanted the court to be aware of the earlier leak in light of its investigation into who leaked Alito’s opinion in Dobbs v. Mississippi – the decision that overturned a woman’s constitutional right to abortion.

“Now when you read the reporting on the leak of the Hobby Lobby decision, with frankly some email traffic that I’ve read that tends to inferentially support that Alito leaked it,” Kirschner said, accusing the Justice of attempting to deflect while claiming to be a “victim” of the leaks.
This takes us to the core issue of impeachment. It has to be on the table when you have somebody like then-Judge Alito deceiving the Senate and deceiving the American people in his confirmation testimony. We also learned recently that he deceived the late Senator Ted Kennedy (D-MA) in one-on-one interviews when Sen. Kennedy was trying to assess whether Alito would be good to his word that Roe v. Wade had nothing to worry about if he were confirmed to the Supreme Court.
“That turned out to be a lie,” Kirschner said. “Both the Hobby Lobby decision and the Dobbs decision were a victory of religion of the rule of law.”
Justices Alito, Brett Kavanaugh, and Amy Coney Barrett have come under scrutiny after all three lied during their confirmation hearings – hiding their true intentions to see the legislation overturned. The leak of the Dobbs decision in the spring, set off a wave of abortion rights protests around the country, demanding the justices be held accountable for perjuring themselves before the United States Senate.
