FINAL NAIL: Failed MAGA candidate loses yet again thanks to Michigan court

The baseless lawsuit challenging the integrity of the 2020 election filed by the former Republican candidate for Michigan Attorney General, Matthew DePerno, has been rejected by the state’s highest court.

The Michigan Supreme Court upheld a lower court’s decision dismissing DePerno’s frivolous and baseless claims of election fraud.

“On order of the Court, the application for leave to appeal the April 21, 2022 judgment of the Court of Appeals is considered, and it is DENIED,” the two-page decision states, “because we are not persuaded that the questions presented should be reviewed by this Court.”

The complaint was based on a glitch caused by human error that briefly showed then-Presidential candidate Joe Biden leading Donald Trump in Ruby Red Antrim County.

Though the mistake was promptly corrected and had no impact on the election results — Trump won the county – it didn’t stop the former tax attorney from jumping on the unsubstantiated election fraud bandwagon.

“It was quickly seized upon by Trump and his allies in an effort to spread baseless conspiracy theories and cast doubt on the legitimacy of the election,” according to The Detroit Metro Times.

DePerno used the campaign trail to call for a forensic audit of ballots cast in the county based on a clause in the state’s constitution four years ago that gives every eligible Michigan voter the right to have votes audited to “ensure the accuracy and integrity of elections,” The Detroit Metro Times reported.

Conservative Justice David Viviano agreed with the lower court’s decision.

“I concur in the Court’s denial order because I believe the Court of Appeals properly rejected plaintiff’s argument that he has a right to conduct an independent audit of election,” he wrote in a concurring opinion.

“These fraudulent claims were utilized to undermine the electorate’s faith in our system of elections,” recently re-elected Michigan Attorney General Dana Nessel said, “not just in Michigan but, nationwide.” Nessel, who stepped in on behalf of Secretary of State Jocelyn Benson, continued, “Not a single member of the Court believed the claims made by the plaintiff or his counsel were worthy of consideration.”

Viviano questioned whether a Michigan resident’s right to call for an audit was a tool to invite challenges to the results of the state’s elections or to be used to reflect on how an election was conducted and used to look for ways they can be improved.

Now DePerno’s time-wasting litigation has officially been put to bed, he has plenty of time to work on his defense in the state’s criminal investigation into allegations that the ultra-MAGA former attorney tampered with voting machine tabulators.

“Let this be the nail in the coffin for the specious claims made during the course of this case,” Nessel said.
