STILL WAITING: It's Tuesday and Trump still hasn't been arrested

Donald Trump told his fans who are following him on his social media safe space that he expected an indictment to be handed down on Tuesday in the New York investigation of his hush money payments to Stormy Daniels.

The latest news from the Manhattan Grand Jury suggests, however, that — whether Trump made it up or got it from an unreliable source — that particular schedule of events didn’t come from them.

The news broke late last week that the Manhattan District Attorney was coordinating with law enforcement and an indictment could come “as soon as” this week.

Trump ran with it, posting on his social media that leaks indicated it would be on Tuesday, and calling for protests against it from his MAGA followers.

Neither massive protests nor an indictment have, so far, come to fruition though.

In fact, as you’ll see below, the protest outside Trump Tower is largely anti-Trump, and the same conservative network that last week said it was expecting an indictment this week, is now admitting that law enforcement doesn’t expect it quite yet.

Meanwhile, the Grand Jury hasn’t yet concluded its work, and after inviting Michael Cohen on Monday to refute testimony by a Trump ally, attorney Robert Costello, the panel plans to reconvene on Wednesday to discuss possible charges.

An indictment won’t hit before the Grand Jury finishes deliberating, and they reportedly have at least one more witness to see first.

From Fox News:

“A law enforcement source told Fox News Monday that the Manhattan District Attorney’s Office and different branches of law enforcement discussed the logistics of closing down streets and putting lights up with generators, extra barriers and extra police. The source said law enforcement does not expect the former president to be arraigned until next week as the Manhattan grand jury – which has been meeting secretly to hear evidence for weeks – has another witness on Wednesday.”

At the same time, things are clearly heating up.

Whether this law enforcement source is accurate or not, the NYPD is getting ready, according to CBS reporter Nicole Sganga, who shared Monday night that all officers, including those normally in plainclothes, have been ordered to wear full uniform starting Tuesday morning, in preparation for a potential indictment and public backlash.

Trump himself seems to be concerned about what’s coming, posting endlessly about it on Truth Social, where he is arguing that the statute of limitations is long past, although, in fact, that would depend on the charge.

If, as speculation suggests, the Grand Jury is considering a charge for falsifying a business record, rather than merely for campaign finance violations, NBC is reporting that this not only has a five-year statute of limitations — not two, as Trump keeps insisting — but that it can be paused when the defendant is not continuously in the state.

That clause likely becomes relevant for a defendant whose years since the alleged crime have been split largely between the White House in Washington D.C. and his current home in Florida.
